The way youtube was breaking the TOS is by serving ads Here is the section of the Adsense TOS which was being violated: "website publishers may not display Google ads on web pages with MP3, Video, News Groups, and Image Results." In fact, I just posted on my blog a comment about Google's two-tier rule system - they regularly overlook their rules for special, premium publishers.
