Is YouTube breaking Google Adsense TOS?

Copyrighted Material

In order to avoid associations with copyright claims, website publishers may not display Google ads on web pages with MP3, Video, News Groups, and Image Results.

Interesting. From what I see here YouTube is in clear violation of Google Adsense TOS. The reason it’s interesting to me is because I’ve had issues with the Adsense team in the past that involved them telling me that I was breaking the TOS for similar reasons.

I guess it just goes to show that if you’ve got the cash you get to pick the rules.

Will we see a change in TOS?

[…] YouTube in violation of Adsense TOS I blogged about this a few minutes ago and figured I would post it here as well. This is what it says on the Google Adsense TOS page. Quote: […]

Interesting that you posted this on the day Google announced it was buying YouTube. In fact, I just posted on my blog a comment about Google’s two-tier rule system - they regularly overlook their rules for special, premium publishers.

Hello e-Rod,
Congrats for you blog! :-)
Could you please tell me about the issue you had with Google team? I’m asking you this because I’d like to know, after all, if one can or cannot publish YouTube’s videos + Adsense ads.
Thanks a lot,
Cheers,
Emiliano.

This is almost a moot point since Google bought youtube on the very day this entry was made.
The way youtube was breaking the TOS is by serving ads

Here is the section of the Adsense TOS which was being violated:
“website publishers may not display Google ads on web pages with MP3, Video, News Groups, and Image Results.”

Clearly, youtube’s add serving was breaking the TOS however, again, this doesn’t make a difference now.
